Please read these terms carefully before booking a tour with Wayward Birdie Tours.

These Terms and Conditions ("Terms") govern your use of the Wayward Birdie Tours website and your participation in any tour operated by Wayward Birdie Tours, a sole proprietorship owned by Chad Cote, based in Whitehorse, Yukon, Canada ("Wayward Birdie," "we," "us," or "our"). By making a booking inquiry, confirming a booking, or participating in a tour, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing this website or booking a tour, you confirm that you have read, understood, and agree to these Terms. If you are booking on behalf of a group, you represent that you have authority to bind all group members and that each member has been made aware of and agrees to these Terms. These Terms may be updated from time to time; the version in effect at the time of your booking applies.

2. Tour Bookings and Payment

All tour bookings are subject to availability and are not confirmed until you receive written confirmation from Wayward Birdie Tours. To secure a booking, payment in full (or a deposit as agreed in writing) is required. Tour prices are quoted in Canadian dollars and are subject to change without notice until a booking is confirmed.

By completing a booking, you confirm that all members of your group meet any stated fitness, age, or health requirements for the tour selected.

3. Cancellation and Refund Policy

We understand that plans change. Our cancellation policy is as follows:

  • More than 72 hours before the tour start time: Full refund of any amount paid.
  • Within 72 hours of the tour start time: 50% refund of the tour price.
  • No-show (failure to appear at the agreed meeting point): No refund.

All cancellation requests must be submitted in writing by email to waywardbirdie@proton.me. The time of receipt of your email determines which cancellation tier applies.

4. Cancellation by Wayward Birdie Tours

We reserve the right to cancel or reschedule a tour at any time due to unsafe weather conditions, trail closures, safety concerns, or other circumstances beyond our reasonable control. In such cases, you will be offered:

  • A full refund of all amounts paid; or
  • The option to reschedule to an available date at no additional cost.

Wayward Birdie Tours is not liable for any additional costs you may incur as a result of a cancellation, including but not limited to travel expenses, accommodation, or equipment rentals.

5. Weather and Outdoor Conditions

Our tours take place outdoors in the Yukon wilderness, where weather conditions can change rapidly and unpredictably. Participation in outdoor activities involves inherent exposure to the natural environment, including variable weather, uneven terrain, wildlife, and remote locations. While we monitor conditions closely and make every effort to ensure safe, enjoyable experiences, we cannot control the natural environment.

Tours may proceed in light rain or overcast conditions. Your guide has sole discretion to modify or curtail a tour in the field if conditions deteriorate to an unsafe level.

6. Assumption of Risk and Limitation of Liability

Outdoor and wilderness activities, including disc golf and hiking, carry inherent risks including but not limited to: physical injury, falls, encounters with wildlife, adverse weather, and other natural hazards. By participating in a Wayward Birdie tour, you voluntarily assume all such inherent risks.

To the maximum extent permitted by applicable Yukon and Canadian law, Wayward Birdie Tours and Chad Cote shall not be liable for any loss, injury, death, property damage, or other harm arising out of or in connection with participation in a tour, except where caused by our gross negligence or wilful misconduct.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for personal injury or death caused by negligence.

7. Guest Responsibilities

To ensure the safety and enjoyment of all participants, guests agree to:

  • Follow all instructions from the guide at all times, including safety-related directions in the field.
  • Arrive at the agreed meeting point on time and prepared for the activity (appropriate clothing, footwear, hydration).
  • Behave respectfully toward other participants, the guide, wildlife, and the natural environment.
  • Not bring or consume alcohol or non-prescribed substances before or during a tour.
  • Not hold Wayward Birdie Tours responsible for the condition, suitability, or loss of any personal equipment you bring to a tour.

Wayward Birdie Tours reserves the right to refuse participation to any guest whose behaviour or physical condition is deemed by the guide to pose a risk to themselves or others, without refund.

8. Medical Conditions and Fitness

Guests are responsible for ensuring that they are in adequate physical health to participate in the selected tour. You must disclose any relevant medical conditions, physical limitations, or allergies to your guide before the tour begins. This includes but is not limited to: heart conditions, asthma, severe allergies (including bee sting), mobility limitations, and pregnancy.

This information will be kept confidential and used solely to ensure your safety. Failure to disclose a relevant medical condition releases Wayward Birdie Tours from any liability arising from that condition during the tour.

Guests are responsible for bringing any personal medications (including EpiPens or inhalers) they may require.

9. Photography and Marketing

Your guide may photograph or record video during the tour for use on the Wayward Birdie Tours website, social media channels, or other marketing materials. By participating in a tour, you grant Wayward Birdie Tours a non-exclusive, royalty-free licence to use such images and footage in which you may appear.

If you prefer not to be photographed or filmed, please notify your guide before the tour begins. We will make every reasonable effort to accommodate your preference.

10. Intellectual Property

All content on the Wayward Birdie Tours website — including text, photographs, graphics, logos, and design — is owned by or licensed to Wayward Birdie Tours and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content from this website without our express written permission.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Yukon Territory and the applicable laws of Canada. Any disputes arising out of or in connection with these Terms or your participation in a tour shall be subject to the exclusive jurisdiction of the courts of the Yukon Territory.
